Upon receipt of the goods, the Purchaser shall examine them for defects without undue delay. The same applies if delivery is not made to him but to a third party named by him. Obvious defects, delivery of the wrong goods, and deviations in quantity shall be reported to the Supplier in writing (e-mail) by the Purchaser without undue delay, no later however than 72 hours from the Purchaser’s receipt of the goods. The notice shall contain a description of how the defect manifests itself and photos proving that. Should the Purchaser fail to provide the Supplier with such notification, the Supplier shall be discharged of any liability for defects in the Products that reasonably could have been detected by such inspections.
Concealed defects shall be reported to the Supplier within a period of eight days following their discovery. If the Purchaser fails to notify the Supplier in writing within the above time limits, he loses his right to make any claim in respect of the defect. If the Purchaser signs for the goods and they turn out to have been damaged, the Supplier will not assume liability. It is also essential to keep the packaging until you are 100% satisfied with the order because, in case of damage, the delivery company will need to inspect the packaging.
After receipt of a written notice under the above clause, the Supplier shall remedy the defect. The Supplier shall be given reasonable time and opportunity for such repair or replacement and any denial of the same by the Purchaser shall discharge the Supplier from his liability.
The Supplier may demand that the Purchaser sends the defective Product to him, or a place instructed by him, for repair or replacement. In such case, the Supplier has fulfilled his obligations in respect of the defect when he delivers a duly repaired or replaced Product to the Purchaser.
